Huh? The courts only issue “opinions”? So abortion is still illegal despite Roe v Wade? So prayer in public schools can still be required despite Engel v. Vitale ? So the police don’t really have to give Miranda rights? And DC can still ban handguns despite the DC v Heller opinion?

Jerry, it looks like we finally got through to you. Yes, courts only offer opinions; they interpret the law. It is up to the executive and legislative branches (they make the laws and enforce them) to take their advice or to tell them to stick it where the sun doesn’t shine. It’s called checks and balances. Our forefathers did not set up this country to give seven appointed people total reign and the power to make or abolish any law depending on which way the wind blows that day. Think about it……..that’s total power and not what our three branch government is all about.
It’s more likely the legislative branch that varies with the wind. The courts, not so much. Judges have tenure; legislatures fear changes in the wind.
So I guess some condemned murderer in a capital punishment state will be glad to know that his death sentence in only an opinion offered by the court.
Speaking of checks and balances, that is precisely what has happened here. The Court has checkmated the legislature for violating the equal protection provision of the Constitution. If you and taco want to amend the Constitution, that is your right, too. Until then, the dumb DOMA law is struck down.
Thank goodness the Dred Scott decision was overruled by the 14th amendment and yet sadly this is why we have the 16th amendment to overrule many supreme court decisions regarding income taxes.
The court can declare law invalid but they cannot declare the Constitution invalid (state or federal) as the people amend it as there must be a ‘law of the land’. People are free to amend their law as they see fit.
Sadly the 16th amendment has been nothing but a curse that should go the way of the 18th amendment as it has done nothing but cause much of the same problems.

DOMA and the 18th amendment were both bad policy. Don’t repeat the mistake of prohibitionists by putting your bad policy into the state constitution.
